1. Agreement to Terms
By accessing or using the Hydrogen Vitality website (the "Website") or purchasing any product or service from us, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, together with our Privacy Policy and Refund & Cancellation Policy, which are incorporated herein by reference.
If you do not agree to these Terms & Conditions, you must immediately discontinue use of the Website and refrain from making any purchase.
2. Our Products and Services
Hydrogen Vitality operates a network of hydrogen-enriched water dispensing machines (the "Machines"). Access to the Machines is granted exclusively through a prepaid IC card system. We do not offer direct payment at the Machines. Our products are as follows:
2.1 Vitality Starter Kit
The Vitality Starter Kit is a one-time purchase that includes:
- One (1) physical IC card ("the Card"), issued and collected in person from the relevant gym information office, which serves as the sole means of accessing the Machines;
- One (1) stainless steel water bottle, for use with the Machines;
- Five (5) litres of hydrogen water credit, preloaded onto the Card upon activation
The Vitality Starter Kit is required for all new customers. It may only be purchased once per customer account.
2.2 Top-Up Credit
Top-Up Credit is prepaid credit purchased through the Website and loaded onto your existing Card. Top-Up Credit enables continued access to and use of the Machines. Top-Up Credits are non-transferable and may only be used on the Card to which they are assigned.
3. Account Registration
To purchase a Vitality Starter Kit or Top-Up Credit, you must create an account on the Website. By registering, you agree to:
- Provide accurate, complete, and up-to-date information at all times;
- Keep your login credentials secure and not share them with any third party;
- Notify us immediately at info@hydrogenvitality.ie if you suspect any unauthorised access to your account;
- Accept full responsibility for all activity conducted through your account.
We reserve the right to suspend or terminate any account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms & Conditions.
4. Pricing and Payment
All prices displayed on the Website are in Euro (€) and are inclusive of any applicable taxes unless otherwise stated. Prices are subject to change at any time without prior notice, but changes will not affect orders already placed and confirmed.
Payment must be made in full at the time of purchase. We accept payment by the methods displayed at checkout. All transactions are processed securely. We do not store your full payment card details.
5. IC Card Terms
5.1 Collection
Once you have completed your Vitality Starter Kit purchase on our Website, the IC card will be distributed at your local gym or clinic. Refer to card collection policy for full details
5.2 Card Activation
Your Card will automatically be activated upon purchase of the Vitality starter Kit and the 5 litres of preloaded credit will be applied to your Card.
5.3 Card Balance and Expiry
Your Card balance represents prepaid credit for Machine use. Card balances do not expire. Your credit will remain available on your Card indefinitely, provided your account remains in good standing and the Card is not reported lost or damaged.
5.4 Lost, Stolen, or Damaged Cards
If your Card is lost, stolen, or damaged, you must notify us as soon as possible at info@hydrogenvitality.ie. Upon notification and verification of your identity and account:
- We will deactivate the compromised Card to prevent unauthorised use.
- A new Card must be purchased on the website to receive the replacement Card.
- Your remaining balance at the time of deactivation will be transferred to your new Card.
We are not liable for any credit used on the Card prior to us receiving your notification of loss, theft, or damage.
5.5 Card Ownership
The Card remains the property of Optimal Engineering Ltd at all times. It is issued to you for personal use only and may not be transferred, sold, or assigned to any third party.
6. Use of the Machines
6.1 Permitted Use
By using a Machine, you agree to:
- Use the Machine only as intended and in accordance with any instructions displayed on or near the Machine;
- Treat the Machine and its surroundings with care and respect;
- Not tamper with, damage, or attempt to interfere with the Machine or its components in any way.
6.2 Machine Availability
While we endeavour to ensure the Machines are operational at all times, we do not guarantee uninterrupted availability. Machines may be temporarily out of service for maintenance, technical reasons, or circumstances beyond our control. We shall not be liable for any loss or inconvenience arising from Machine unavailability.
6.3 Prohibited Conduct
You must not use any Machine or the Website in any manner that is unlawful, fraudulent, harmful, or disruptive. Any attempt to circumvent the Card payment system, manipulate the Machines, or use another person's Card without authorisation may result in immediate account termination and may be reported to the relevant authorities.
7. Right of Withdrawal (EU Consumers)
In accordance with the European Union Consumer Rights Directive (2011/83/EU) and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, as a consumer purchasing via our Website you ordinarily have the right to withdraw from a distance contract within 14 calendar days without giving any reason.
However, please note the following exceptions which apply to our products:
- Top-Up Credit: By completing your purchase of Top-Up Credit, you expressly consent to the immediate loading of credit to your Card and acknowledge that the right of withdrawal is lost once the credit has been applied to your Card.
- Vitality Starter Kit: You may withdraw from the Vitality Starter Kit purchase within 14 days, provided that no credit has been drawn down from the IC Card and the stainless steel bottle has not been used or filled. Once credit has been used on the Card, the right of withdrawal for the prepaid credit element is lost. The bottle may not be returned once it has been used or filled, as it constitutes a hygiene item under Article 16(e) of the EU Consumer Rights Directive.
To exercise your right of withdrawal, you must notify us at info@hydrogenvitality.ie before the withdrawal period expires, clearly stating your intention to withdraw and your order details.
8. Refund & Cancellation Policy
Please refer to our separate Refund & Cancellation Policy for full details of our refund procedures. Nothing in these Terms & Conditions affects your statutory rights under applicable Irish or EU consumer law.
9. Health and Wellness Disclaimer
The information provided on this Website regarding hydrogen-enriched water is intended for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment. Hydrogen Vitality makes no representations or warranties regarding any specific health outcomes or benefits from the use of our Machines or products.
You should not rely on any information provided on this Website as a substitute for professional medical advice. Always consult a qualified healthcare professional before making any decisions regarding your health. Use of the Machines is entirely at your own discretion and risk.
10. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Optimal Engineering Ltd or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or otherwise use any content from the Website without our express prior written consent.
11. Limitation of Liability
To the fullest extent permitted by applicable law:
- We provide our Website, products, and services on an "as is" and "as available" basis, without warranties of any kind, express or implied;
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Website, products, or Machines;
- Our total liability to you for any claim arising under or in connection with these Terms & Conditions shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
Nothing in these Terms & Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Irish or EU law.

14. Governing Law and Dispute Resolution
These Terms & Conditions are governed by and shall be construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Irish courts, without prejudice to your rights as a consumer under applicable EU law.
